TN Visas for Canadian & Mexican Professionals

The TN visa allows qualified Canadian and Mexican citizens to work in the United States in specific professional occupations under the United States-Mexico-Canada Agreement (USMCA) (formerly NAFTA). This nonimmigrant visa provides a streamlined process for professionals in designated fields, such as science, engineering, medicine, finance, and education, to work in the U.S. temporarily.

Our firm provides strategic guidance for TN visa applicants and their U.S. employers, ensuring compliance with immigration regulations and maximizing approval chances.

TN Visa Application Process

For Canadian Citizens (Applying at a U.S. Port of Entry or Preflight Inspection)

1. Prepare Required Documentation

  • Proof of Canadian citizenship (passport).
  • A detailed job offer letter from a U.S. employer specifying job duties, qualifications, and duration of employment.
  • Copies of relevant diplomas, degrees, or certifications.
  • Proof of ability to perform the job (e.g., license, professional memberships).

2. Apply at the Port of Entry or U.S. Preclearance Location

  • Canadian citizens do not require a visa but must apply for TN status at a designated U.S. port of entry or preflight inspection station.
  • If approved, U.S. Customs and Border Protection (CBP) grants TN status, typically valid for up to three years.

For Mexican Citizens (Applying at a U.S. Consulate)

1. Submit Form DS-160

  • Complete the online nonimmigrant visa application (Form DS-160) and pay the visa fee.

2. Schedule and Attend a Visa Interview

  • Attend an appointment at a U.S. consulate or embassy in Mexico.
  • Bring the job offer letter, proof of qualifications, and valid Mexican passport.

3. TN Visa Issuance and Entry to the U.S.

  • If approved, the consulate issues the TN visa, which allows entry into the U.S. to begin employment.

TN Visa Renewal & Extension

TN status is typically granted for up to three years and may be renewed indefinitely in three-year increments.

Extensions can be filed through USCIS using Form I-129 or by applying at a U.S. port of entry (for Canadians).

Benefits of the TN Visa

No annual cap, unlike the H-1B visa.

Lower cost and simpler application process for Canadian applicants.

Faster processing compared to other work visas.
